3. How We Use Your Information

We use collected information for the following purposes:

• To process early-access registrations and send launch notifications.
• To deliver, maintain, and improve our AI and digital transformation services.
• To analyse service performance, usage patterns, and model accuracy.

We do not sell personal data. We may share information with:

• Service Providers: Trusted third-party vendors who assist in operating our infrastructure, analytics, and communications, under strict data processing agreements.
• Enterprise Clients: Data may be shared within the client's own organizational environment as part of contracted service delivery.
• Legal Authorities: When required by applicable Saudi law or regulatory authority, or to protect the rights, safety, and property of Ebhar and its users.
• Business Transfers: In connection with a merger, acquisition, or asset sale, subject to confidentiality obligations.

6. Data Retention

We retain personal data only as long as necessary for the purposes described in this policy, or as required by law. Early-access contact information is retained until you unsubscribe or request deletion. Enterprise client data is retained per the terms of each service agreement.

7. Your Rights

Under the Saudi Personal Data Protection Law (PDPL) and applicable regulations, you have the right to:

• Request correction of inaccurate or incomplete data.
• Request deletion of your personal data, subject to legal retention requirements.
• Withdraw consent where processing is based on consent.

3. Early Access Registration

By submitting your email address and name on our website to receive early access notifications, you agree to receive communications from Ebhar about our product launch and related updates. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting ask@ebhar.ai. We will not use your registration information for any purpose other than as stated in our Privacy Policy.

4. Intellectual Property

All content on the Ebhar website, including but not limited to text, graphics, logos, trademarks, software, AI models, product names, and service descriptions, is the exclusive property of Ebhar or its licensors and is protected under applicable intellectual property laws in the Kingdom of Saudi Arabia and internationally.

In the event of any conflict between these Terms and an applicable service agreement, the service agreement shall prevail with respect to the subject matter therein.

7. AI & Data Services Disclaimer

Ebhar's AI-powered services are provided as professional enterprise tools. While we strive for accuracy and reliability, AI outputs should be reviewed by qualified professionals before being used as the sole basis for critical business, legal, financial, or operational decisions. Ebhar does not warrant that AI outputs will be error-free or meet all client-specific requirements in every instance.

8. Limitation of Liability

To the maximum extent permitted by Saudi Arabian law, Ebhar and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the website or services, including loss of data, revenue, or business opportunities.

Ebhar's total liability in connection with these Terms shall not exceed the amounts paid by you to Ebhar in the twelve (12) months preceding the claim, or SAR 1,000 where no fees have been paid.

9. Indemnification

You agree to indemnify and hold harmless Ebhar, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any applicable law or regulation; or (c) your misuse of our website or services.

10. Third-Party Links & Integrations

Our website or services may contain links to third-party websites or integrate with third-party platforms. Ebhar is not responsible for the content, privacy practices, or terms of such third parties. Your use of third-party services is at your own risk and subject to the terms of those respective services.

11. Availability & Modifications

We reserve the right to modify, suspend, or discontinue any part of our website or services at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services. We may also update these Terms from time to time. 12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Saudi Arabia.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

• البيانات المعالجة بالذكاء الاصطناعي وبيانات التحليلات: البيانات التشغيلية ومدخلات ومخرجات النماذج الذكية وخطوط أتمتة العمليات ضمن تقديم الخدمات للعملاء المؤسسيين.
• البيانات التقنية: عنوان IP، نوع المتصفح، معلومات الجهاز، والصفحات التي تمت زيارتها، ويتم جمعها تلقائياً من خلال ملفات تعريف الارتباط وسجلات الخادم.
• بيانات التواصل: الرسائل والاستفسارات والملاحظات المرسلة عبر قنوات التواصل لدينا.

3. كيفية استخدام معلوماتك

نستخدم المعلومات المجمعة للأغراض التالية:

• معالجة تسجيلات الوصول المبكر وإرسال إشعارات الإطلاق.
• تقديم خدمات الذكاء الاصطناعي والتحول الرقمي وصيانتها وتحسينها.
• تحليل أداء الخدمات وأنماط الاستخدام ودقة النماذج.
• التواصل بشأن التحديثات المهمة والتنبيهات الأمنية ومعلومات الخدمة.
• الامتثال للالتزامات القانونية بموجب القانون السعودي واللوائح الدولية المعمول بها.
• الحماية من الاحتيال والوصول غير المصرح به وسوء استخدام أنظمتنا.

4. الأساس القانوني للمعالجة

تستند معالجتنا للبيانات الشخصية إلى: (أ) موافقتك، حيثما حصلنا عليها؛ (ب) ضرورة تنفيذ عقد معك أو مع مؤسستك؛ (ج) الامتثال للقوانين واللوائح المعمول بها، بما في ذلك نظام حماية البيانات الشخصية (PDPL) في المملكة العربية السعودية؛ و(د) مصالحنا التجارية المشروعة بما يتوازن مع حقوق خصوصيتك.

5. مشاركة البيانات والإفصاح عنها

لا نبيع البيانات الشخصية. قد نشارك المعلومات مع:

• مزودي الخدمات: موردون خارجيون موثوقون يساعدون في تشغيل بنيتنا التحتية والتحليلات والاتصالات، بموجب اتفاقيات معالجة بيانات صارمة.
• العملاء المؤسسيين: يمكن مشاركة البيانات ضمن البيئة التنظيمية للعميل كجزء من تقديم الخدمات المتعاقد عليها.
• الجهات القانونية: عند الاقتضاء بموجب القانون السعودي المعمول به أو الجهة التنظيمية المختصة، أو لحماية حقوق وسلامة وممتلكات ابحار ومستخدميها.
• عمليات الأعمال: فيما يتعلق بالاندماج أو الاستحواذ أو بيع الأصول، مع الالتزام بواجبات السرية.

6. الاحتفاظ بالبيانات

نحتفظ بالبيانات الشخصية فقط طالما كان ذلك ضرورياً للأغراض الموضحة في هذه السياسة، أو وفقاً لما يقتضيه القانون. يتم الاحتفاظ بمعلومات تسجيل الوصول المبكر حتى إلغاء الاشتراك أو طلب الحذف. يتم الاحتفاظ ببيانات العملاء المؤسسيين وفقاً لشروط كل اتفاقية خدمة.

7. حقوقك

بموجب نظام حماية البيانات الشخصية (PDPL) السعودي واللوائح المعمول بها، يحق لك:

• الاطلاع على البيانات الشخصية التي نحتفظ بها عنك.
• طلب تصحيح البيانات غير الدقيقة أو الناقصة.
• طلب حذف بياناتك الشخصية، مع مراعاة متطلبات الاحتفاظ القانونية.
• سحب الموافقة حين تستند المعالجة إليها.
• تقديم شكوى إلى هيئة البيانات والذكاء الاصطناعي (سدايا) بوصفها الجهة الإشرافية المختصة بموجب نظام حماية البيانات الشخصية. الموقع الإلكتروني: sdaia.gov.sa

8. أمن البيانات

نطبّق تدابير أمنية تقنية وتنظيمية بمستوى الصناعة، تشمل التشفير أثناء النقل والتخزين، وضوابط الوصول، ومراجعات أمنية دورية، لحماية بياناتك من الوصول غير المصرح به أو الفقدان أو الإفصاح. غير أنه لا يوجد نظام آمن تماماً، وننصح المستخدمين باتخاذ الاحتياطات اللازمة عند مشاركة المعلومات الحساسة عبر الإنترنت.

9. ملفات تعريف الارتباط والتتبع

يستخدم موقعنا ملفات تعريف الارتباط وتقنيات التتبع المماثلة لتحسين تجربة المستخدم وتحليل أداء الموقع. يمكنك التحكم في تفضيلات ملفات تعريف الارتباط من خلال إعدادات المتصفح. قد يؤثر تعطيل ملفات تعريف الارتباط على وظائف بعض الميزات.

10. النقل الدولي للبيانات

إذا جرت أي معالجة للبيانات خارج المملكة العربية السعودية، تحرص ابحار على توفير ضمانات مناسبة وفقاً لنظام PDPL، تشمل الحماية التعاقدية وآليات نقل البيانات عبر الحدود المعتمدة من الجهة المختصة.

11. خصوصية الأطفال

خدماتنا موجهة للمستخدمين التجاريين والمؤسسيين وليست موجهة للأفراد دون سن 18 عاماً. لا نجمع عمداً بيانات شخصية من القاصرين.

12. التغييرات على هذه السياسة

قد نحدّث سياسة الخصوصية هذه دورياً لتعكس التغييرات في ممارساتنا أو المتطلبات القانونية. سنُعلم المستخدمين المسجلين بالتغييرات الجوهرية عبر البريد الإلكتروني أو من خلال إشعار على موقعنا. يُعدّ استمرار استخدام خدماتنا بعد التحديثات قبولاً للسياسة المُعدَّلة.

ابحار شركة للذكاء الاصطناعي المؤسسي والتحول الرقمي مسجلة في المملكة العربية السعودية. تقدم الشركة خدمات استراتيجية الذكاء الاصطناعي وأتمتة العمليات وذكاء البيانات والحلول السحابية والذكاء الاصطناعي التوليدي للعملاء المؤسسيين.

3. التسجيل للوصول المبكر

بإدخال بريدك الإلكتروني واسمك على موقعنا لتلقي إشعارات الوصول المبكر، فإنك توافق على تلقّي اتصالات من ابحار حول إطلاق منتجاتنا والتحديثات ذات الصلة. يمكنك إلغاء الاشتراك في أي وقت عبر رابط إلغاء الاشتراك في أي بريد إلكتروني أو بالتواصل معنا على ask@ebhar.ai. لن نستخدم معلومات تسجيلك لأي غرض آخر غير ما هو محدد في سياسة الخصوصية.

4. الملكية الفكرية

جميع المحتويات على موقع ابحار الإلكتروني، بما في ذلك على سبيل المثال لا الحصر: النصوص، والرسومات، والشعارات، والعلامات التجارية، والبرمجيات، ونماذج الذكاء الاصطناعي، وأسماء المنتجات، وأوصاف الخدمات، هي ملك حصري لابحار أو مُرخِّصيها وتخضع لحماية قوانين الملكية الفكرية المعمول بها في المملكة العربية السعودية وعلى المستوى الدولي.

لا يجوز لك إعادة إنتاج أي محتوى من موقعنا أو خدماتنا أو توزيعه أو تعديله أو استغلاله تجارياً دون إذن كتابي صريح منا.

5. استخدام الخدمات

تلتزم باستخدام موقعنا وخدماتنا لأغراض مشروعة فقط ووفقاً لجميع القوانين واللوائح المعمول بها. يُحظر عليك:

• استخدام خدماتنا لمعالجة أو نقل بيانات غير مشروعة أو ضارة أو احتيالية.
• محاولة الوصول غير المصرح به إلى أي جزء من أنظمتنا أو بنيتنا التحتية.
• استخدام أدوات آلية لاستخراج البيانات أو الزحف عبر موقعنا الإلكتروني دون إذن.
• الانخراط في أي نشاط يعطّل أو يضرّ أو يُخلّ بأداء أنظمتنا أو خدماتنا.
• انتحال الهوية أو ادعاء انتماءات زائفة عند التعامل مع ابحار.

6. اتفاقيات الخدمة المؤسسية

يخضع تقديم خدمات الذكاء الاصطناعي والتحول الرقمي لعملاء ابحار المؤسسيين لاتفاقيات خدمة مكتوبة منفصلة أو عقود عمل مُبرمة بين ابحار والعميل. في حالة أي تعارض بين هذه الشروط واتفاقية الخدمة المعمول بها، تسود اتفاقية الخدمة فيما يخص الموضوع المنظَّم بها.

7. إخلاء المسؤولية عن خدمات الذكاء الاصطناعي والبيانات

تُقدَّم خدمات ابحار المدعومة بالذكاء الاصطناعي بوصفها أدوات مؤسسية احترافية. وبينما نسعى جاهدين لتحقيق الدقة والموثوقية، ينبغي مراجعة مخرجات الذكاء الاصطناعي من قِبل متخصصين مؤهلين قبل اعتمادها أساساً وحيداً لاتخاذ قرارات تجارية أو قانونية أو مالية أو تشغيلية بالغة الأهمية. لا تضمن ابحار أن تكون مخرجات الذكاء الاصطناعي خالية تماماً من الأخطاء أو أنها ستستوفي جميع متطلبات العملاء المحددة في كل الأحوال.

8. تحديد المسؤولية

في أقصى الحدود التي يسمح بها القانون السعودي، لن تكون ابحار ومديروها ومسؤولوها وموظفوها ووكلاؤها مسؤولين عن أي أضرار غير مباشرة أو عرضية أو تبعية أو خاصة أو عقابية ناجمة عن استخدامك أو عدم قدرتك على استخدام الموقع أو الخدمات، بما في ذلك فقدان البيانات أو الإيرادات أو الفرص التجارية.

لا تتجاوز المسؤولية الإجمالية لابحار في إطار هذه الشروط المبالغ التي دفعتها لابحار خلال اثني عشر (12) شهراً السابقة للمطالبة، أو 1,000 ريال سعودي في حال عدم سداد أي رسوم.

9. التعويض

توافق على تعويض ابحار وشركاتها التابعة ومسؤوليها ومديريها وموظفيها ووكلائها وإعفائهم من أي مطالبات أو مسؤوليات أو أضرار أو خسائر أو نفقات (بما فيها أتعاب المحامين المعقولة) الناشئة عن: (أ) إخلالك بهذه الشروط؛ (ب) انتهاكك لأي قانون أو لائحة معمول بها؛ أو (ج) إساءة استخدامك لموقعنا أو خدماتنا.

10. الروابط والتكاملات الخارجية

قد يحتوي موقعنا أو خدماتنا على روابط لمواقع إلكترونية تابعة لأطراف ثالثة أو يتكامل مع منصاتها. لا تتحمل ابحار المسؤولية عن محتوى تلك الأطراف أو ممارسات الخصوصية لديها أو شروطها. يكون استخدامك لخدمات الأطراف الثالثة على مسؤوليتك الخاصة وخاضعاً لشروط كل منها.

11. التوافر والتعديلات

نحتفظ بالحق في تعديل أي جزء من موقعنا أو خدماتنا أو تعليقه أو إيقافه في أي وقت دون إشعار مسبق. لا نتحمل أي مسؤولية تجاهك أو تجاه أي طرف ثالث جراء أي تعديل أو تعليق أو إيقاف للخدمات. يجوز لنا أيضاً تحديث هذه الشروط من وقت لآخر. سنُعلم المستخدمين المسجلين بالتغييرات الجوهرية. يُعدّ استمرار استخدام خدماتنا بعد التحديثات قبولاً للشروط المُعدَّلة.

12. القانون الحاكم وتسوية النزاعات

تخضع هذه الشروط وتُفسَّر وفقاً لقوانين المملكة العربية السعودية. يخضع أي نزاع ينشأ عن هذه الشروط أو يتصل بها للاختصاص القضائي الحصري للمحاكم المختصة في مدينة الرياض بالمملكة العربية السعودية.

13. قابلية التجزئة

إذا تبيّن أن أي حكم من أحكام هذه الشروط غير صالح أو غير قابل للتطبيق، تظل الأحكام الأخرى سارية المفعول بالكامل.
